Welcome to Cusprint. This website (the "Site") and the custom printing e-commerce services offered herein (the "Services") are operated by Hong Kong Primadawn Group Limited (referred to interchangeably as the "Company", "we", "us", or "our").

By accessing or using our Site, hosting a user account, purchasing our custom merchandise, or utilizing our services, you agree to be bound by the following terms and conditions ("Terms of Service", "Terms"), including those additional terms, conditions, and policies referenced herein or available by hyperlink.

1. Store Platform & Eligibility

1.1 Shopify Hosting

Our e-commerce storefront is hosted on Shopify Inc. They provide us with the online platform that allows us to market, display, and sell our custom printing services to you worldwide.

1.2 Age Limitations

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state, province, or country of residence. Our services are not intended for or directed toward individuals under the age of 16.

1.3 Service Refusal

We reserve the right to refuse service, terminate accounts, or cancel orders at our sole discretion, without limitation, if we believe customer conduct violates applicable laws or is harmful to the interests of the Company.

2. Intellectal Property & User Content Guidelines

As a custom print-on-demand platform, you may upload graphics, photos, logos, artwork, and text ("User Content") to be printed on physical products.

2.1 Ownership of Your Content

You retain full ownership, copyrights, and intellectual property rights to any User Content you upload to Cusprint. By uploading User Content, you grant the Company and its manufacturing partners a non-exclusive, worldwide, royalty-free license to use, reproduce, and modify (solely for sizing, formatting, or manufacturing purposes) your content for the exclusive purpose of fulfilling your order.

2.2 Prohibited Content Standards

You are strictly prohibited from uploading or submitting any User Content that:

  • Infringes upon any third-party copyrights, trademarks, privacy rights, or intellectual property rights.

  • Contains defamatory, obscene, pornographic, hateful, or racially discriminatory material.

  • Promotes illegal activities, violence, or harm against any individual or community.

  • Violates any local, national, or international laws.

⚖️ Legal Indemnification: If you submit an image or logo that belongs to a third party (e.g., trademarked logos, copyrighted artwork) without written permission, you assume 100% legal liability. You agree to indemnify, defend, and hold harmless Hong Kong Primadawn Group Limited against any legal claims, damages, costs, or attorney fees resulting from copyright or trademark infringement actions brought by third parties.

3. Orders, Pricing, and Product Accuracy

3.1 Order Acceptance

An order configuration submitted through our Shopify checkout constitutes an offer to purchase. We reserve the right to accept or decline your order at any time after receipt, particularly if your uploaded Print Files violate our Prohibited Content Standards or fail quality check standards.

3.2 Prices & Currency

All prices are subject to change without notice. Depending on your configuration, local taxes, import duties, and global shipping tiers will be calculated at checkout.

3.3 Print Variations and Digital Previews

Because our products are entirely customized, you acknowledge that:

  • Color Matching: On-screen digital previews (RGB) may vary slightly from physical printed ink finishes (CMYK/Pantone). Minor color, alignment, and scale variations within acceptable industry standards do not constitute a defect.

  • File Resolution: We are not responsible for blurry or pixelated prints if the file uploaded by you does not meet our minimum resolution requirements.

4. Production and Global Logistics

Your relationship with us regarding timelines is strictly governed by our standalone operational policies:

  • Production: Custom design production normally lasts 7 to 10 business days depending on quantity and complexity before dispatching.

  • Logistics & Duties: International orders may face customs inspections and import fees depending on your home country. These terms are fully outlined in our Shipping Policy.

5. Limitation of Liability & Warranties

  • As-Is Basis: The Site and Services are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied.

  • Liability Cap: To the maximum extent permitted by applicable law, Hong Kong Primadawn Group Limited shall not be liable for any indirect, incidental, punitive, or consequential damages (including loss of profits, data, or business goodwill) arising out of the use of our services or products.

  • In no event shall our total financial liability to you exceed the exact amount paid by you for the specific product order out of which the liability arose.

6. Indemnification

You agree to indemnify, defend, and hold harmless Hong Kong Primadawn Group Limited, our subsidiaries, affiliates, partners, officers, directors, agents, contractors, and employees from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your breach of these Terms of Service or your violation of any law or the rights of a third party.

7. Governing Law and Dispute Resolution

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by, interpreted, and construed in accordance with the laws of the Hong Kong Special Administrative Region (HKSAR).

Any dispute, controversy, or claim arising out of or relating to these Terms, including the validity, invalidity, breach, or termination thereof, shall be submitted to the exclusive jurisdiction of the courts of Hong Kong.

8. Severability & Entire Agreement

If any provision of these Terms of Service is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severed from these Terms. Such determination shall not affect the validity and enforceability of any other remaining provisions.
